<strong>contratar a una persona para pr\u00e1cticas cuando ha finalizado sus estudios es ilegal<\/strong>, obligando a una empresa a integrar en su plantilla a una joven que fue contratada como becaria, a pesar de que ya ten\u00eda un t\u00edtulo de m\u00e1ster y no estaba matriculada en la universidad.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_80 counter-flat que contratar a la becaria como empleada regular<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Tal y como podemos leer en <a href=\"https:\/\/www.poderjudicial.es\/search\/AN\/openDocument\/0d7f3212c70d2c2ea0a8778d75e36f0d\/20240530\">la sentencia<\/a>, la empresa gallega registr\u00f3 a la joven como becaria el 2 de noviembre de 2021, despu\u00e9s de que ella enviara su curr\u00edculum se\u00f1alando que hab\u00eda completado un Master de Direcci\u00f3n de Recursos Humanos y Gesti\u00f3n Laboral y deseaba incorporarse al mercado laboral, siendo contratada tras superar una entrevista.<\/p>\n\n\n\n<p>Sus funciones inclu\u00edan aprender a formalizar contratos de trabajo, manejar el sistema RED y confeccionar n\u00f3minas, entre otras tareas. Estas actividades, seg\u00fan le informaron, eran <strong>formativas y se realizar\u00edan bajo la supervisi\u00f3n directa del tutor o de cualquier empleado del despacho<\/strong>, con una remuneraci\u00f3n mensual de 500 euros.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Una_inspeccion_de_trabajo_revelo_el_fraude_de_ley_al_contratar_a_la_becaria\"><\/span>Una inspecci\u00f3n de trabajo revel\u00f3 el fraude de ley al contratar a la becaria<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Sin embargo, tras una inspecci\u00f3n de trabajo el 22 de marzo de 2022, se declar\u00f3 que el alta de la joven como becaria era indebida. Se determin\u00f3 que ten\u00eda que ser contratada como empleada a tiempo completo y bajo r\u00e9gimen laboral com\u00fan.<\/p>\n\n\n\n<p>La inspecci\u00f3n fundament\u00f3 esta decisi\u00f3n en que hab\u00eda finalizado su m\u00e1ster antes de empezar a trabajar en la empresa. Entend\u00eda que la compa\u00f1\u00eda hab\u00eda cometido fraude de ley al encubrir un contrato ordinario con una beca, ya que realizaba tareas propias de una empleada regular.<\/p>\n\n\n\n<p>La empresa, considerando injusta la decisi\u00f3n, present\u00f3 un recurso de alzada que fue desestimado por la Tesorer\u00eda General de la Seguridad Social, argumentando esta \u00faltima que las pr\u00e1cticas deber\u00edan estar vinculadas al m\u00e1ster.<\/p>\n\n\n\n<p>Al completar la joven sus estudios de postgrado, <strong>le correspond\u00eda una contrataci\u00f3n laboral ordinaria o un contrato formativo<\/strong> previsto en el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430&amp;p=20240522&amp;tn=1#a11\">art\u00edculo 11 del Estatuto de los Trabajadores<\/a>, en lugar de un contrato bajo el <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2014-8138\">Real Decreto 592\/2014, que regula las pr\u00e1cticas acad\u00e9micas externas de los estudiantes universitarios<\/a>.<\/p>\n\n\n\n<p><strong>El contrato de trabajo para la obtenci\u00f3n de pr\u00e1ctica profesional s\u00ed puede concertarse dentro de los tres a\u00f1os siguientes a la terminaci\u00f3n de los estudios.<\/strong> Estos pueden llegar a cinco cuando se trata de una persona con discapacidad.<\/p>\n\n\n\n<p>La letrada de la Seguridad Social tambi\u00e9n observ\u00f3 que la trabajadora <strong>desempe\u00f1aba sus <a href=\"https:\/\/jjfconsultores.com\/index.php\/2024\/02\/12\/funciones-laborales-hasta-donde-pueden-modificar-las-tuyas\/\">funciones laborales<\/a> como cualquier otro empleado de la empresa, sin existir un plan de formaci\u00f3n real<\/strong>. As\u00ed, concluy\u00f3 que se estaba encubriendo un contrato ordinario, <strong>reclamando a la empresa unas cuotas por importe de 2.977,43 euros<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"El_Tribunal_Superior_de_Justicia_de_Galicia_avala_la_decision_de_contratar_a_la_becaria\"><\/span>El Tribunal Superior de Justicia de Galicia avala la decisi\u00f3n de contratar a la becaria<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>La compa\u00f1\u00eda aleg\u00f3 ante el Tribunal Superior de Justicia de Galicia que la apreciaci\u00f3n de la inspectora estaba \u201cdesvirtuada\u201d, pero entre otras precisiones, el TSJ record\u00f3 que el <strong>art\u00edculo 8 del Real Decreto 592\/2014 excluye a la joven como destinataria de un contrato de pr\u00e1cticas<\/strong>.<\/p>\n\n\n\n<p>Dicho art\u00edculo prev\u00e9 como necesaria la <strong>matriculaci\u00f3n en una ense\u00f1anza universitaria<\/strong> a la que se vinculen las competencias a adquirir por el estudiante, <strong>estar matriculado en la asignatura vinculada<\/strong>, seg\u00fan el Plan de Estudios de que se trate <strong>y no mantener relaci\u00f3n contractual con la empresa<\/strong>, instituci\u00f3n o entidad p\u00fablica o privada o la propia universidad donde se realicen las pr\u00e1cticas, salvo autorizaci\u00f3n con arreglo a la normativa de cada universidad.<\/p>\n\n\n\n<center><blockquote class=\"instagram-media\" data-instgrm-permalink=\"https:\/\/www.instagram.com\/reel\/C8Yxnn9CSNH\/?utm_source=ig_embed&amp;utm_campaign=loading\" data-instgrm-version=\"14\" style=\" background:#FFF; Una vez finalizado el curso, y no estando matriculado en ninguna instituci\u00f3n educativa, el contrato de pr\u00e1cticas ya no es v\u00e1lido, ya que su finalidad es complementar la formaci\u00f3n te\u00f3rica con experiencia pr\u00e1ctica en un entorno laboral, lo cual no puede ser justificado si el estudiante ha completado su formaci\u00f3n.
